This agreement has been written for Architect Render, LLC ("Architect Render") for use of all Website, Website Application, and AI-powered services. By accessing this Website, accessible from https://architectrender.com, you are agreeing to be bound by these Website Terms and Conditions of Use and agree that you are responsible for the agreement with any applicable local laws. If you disagree with any of these terms, you are prohibited from accessing this site. The materials contained in this Website are protected by copyright and trademark law.

2. Service Description

Architect Render is a premier AI-powered Architectural Rendering and Interior Designing platform that generates high-quality architectural renders and designs. Our services include:

• AI-powered architectural rendering generation

• Interior/Exterior design visualization

• Virtual staging

• Project file management system

• Access to a vetted professional design network

• Community features and support

3. Eligibility

Users must be at least 13 years of age and able to form legally binding contracts to access the Site and use the Services. If you are below this age of consent or otherwise unable to form legally binding contracts to use online services, you may not access the Site or use the Services.

4. Account Registration and Security

To access certain features of the Platform, you may be required to create an account by providing accurate, current, and complete information. You agree to update your information promptly to maintain its accuracy and completeness. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must promptly notify Architect Render of any unauthorized use or suspected breach of security. Architect Render shall not be liable for any loss or damage arising from your failure to comply with these requirements.

5. Use License and Intellectual Property Rights

5.1 Generated Content Ownership
All renderings generated by Architect Render are 100% wholly-owned by Architect Render clients and can be used for their personal and/or commercial use, provided that all applicable fees have been paid and these Terms have not been violated.
5.2 Platform License
Permission is granted to access and use the Application-generated materials on Architect Render's Website Application, accessible from https://app.architectrender.com based on your subscription package or credit purchase. This license is non-transferable and subject to these Terms.
5.3 Restrictions
Under this license you may not:

• Modify or copy the platform materials

• Attempt to reverse engineer any software contained on Architect Render's Website or Website Application

• Remove any copyright or other proprietary notations

• Transfer the materials to another person or "mirror" the materials on any other server

• Use the platform for any illegal or unauthorized purpose

5.4 Platform Ownership & Reservation of Rights
All rights, title, and interest in and to the Platform (including all software, content, designs, data, and materials) are and shall remain the exclusive property of Architect Render and its licensors. Except for the limited license expressly granted to you in these Terms, no other rights or licenses are granted, whether by implication, estoppel, or otherwise.
5.5 Trademarks
The trademarks, service marks, trade names, logos, slogans, and other identifiers displayed on the Platform are the registered and unregistered marks of Architect Render, LLC or its affiliates or licensors (“Architect Render Marks”). You may not use, reproduce, modify, or display any Architect Render Marks, or any mark confusingly similar thereto, without the prior written consent of Architect Render.
5.6 Feedback
If you provide Architect Render with any suggestions, feedback, ideas, or recommendations regarding the Platform or services (“Feedback”), you hereby grant Architect Render a perpetual, irrevocable, worldwide, royalty-free, fully paid, transferable, sublicensable license to use, modify, implement, commercialize, and otherwise exploit such Feedback for any purpose, without any obligation to compensate you.
5.7 Copyright Infringement Notices (DMCA)
Architect Render respects the intellectual property rights of others. 6. Credits, Subscription Terms & Billing

6.1 Credit Validity
Individual credits purchased outside of subscriptions remain valid for 12 months from the purchase date. Users may extend credit validity for an additional year for a fee of $1.99, regardless of credit quantity.
6.2 Subscription Terms
Subscriptions are billed on a recurring basis. Users may purchase additional credits alongside their subscription. Additional credits maintain subscription-level benefits while the subscription is active. No long-term commitments required; cancel at any time.
Certain Services are only available with an auto-renewing subscription. Unless otherwise governed by a Master Services Agreement entered into and executed by the parties, this Agreement will govern the subscription. The Subscription Period will be selected by the User upon signing up for our Services. The subscription fee varies by level of service and Subscription Period selected. During the Subscription Period the User may access the Services. At the end of each Subscription Period, your subscription will be automatically renewed for successive Subscription Periods until cancelled. If you do not wish to continue your subscription, you may terminate your subscription before your current subscription period ends. Subscription prices may change from time to time and by continuing to use the Service you agree to the price change.
The Company may offer certain customers various trial or other promotional subscriptions to the subscription plan, which are subject to these Terms except as otherwise stated in the promotional offers. Trial subscribers may at any time choose to cancel at any time prior to the end of the trial period. If you do not cancel during the trial period, users will automatically be enrolled in a paid subscription. If Users cancel during the trial period, your access to the subscription services will be terminated upon the expiration of your trial period.
Upon registering for a subscription, Users are required to provide a valid payment method. Subscription Fees must be paid using a lawfully issued credit or debit card for which you have authorization to make a charge. The Company reserves the right to block access to your Account until a valid credit or debit card has been provided to cover all charges incurred by you. You are solely responsible for any late payment charges, overdraft fees or other charges incurred by you as a result of your use of a credit or debit card to pay a subscription fee.
The Company reserves the right to change the price for a Subscription Period at any time. Price changes for a Subscription Period will take effect at the start of the next Subscription Period following the date of the price change and will be communicated to Users affected by the change before such date. By continuing to use the Services after the price change takes effect, you agree to accept the new price.
You may cancel your subscription of the Services at any time, and you will continue to have access to the Services throughout your Subscription Period. We do not provide refunds, right to return for a purchased subscription, credits for any partially used subscription or unused Account, or by reason of your dissatisfaction with the Services. As the subscription gives you access to the Services instantaneously after the purchase, the Company does not offer a right of return (such as refunding the subscription fee). To cancel your Subscription, go to the account settings when logged in on your User Account and follow the instructions for cancellation.
6.3 Revisions
Each credit includes up to 10 revisions per rendering project for subscription users. Revision counts may vary based on the type of credit purchase or subscription tier.

7. Usage Rules and User Conduct

7.1 Acceptable Use
You agree to use the Architect Render platform, services, and all related content only for lawful purposes and in accordance with these Terms. You specifically agree not to:

• Upload, submit, or transmit any infringing, unlawful, or otherwise objectionable content

• Use the Service to impersonate others, collect user data without consent, or send unsolicited communications

• Interfere with or disrupt the Service or its networks

• Attempt to gain unauthorized access

• Use bots, scrapers, or automated tools without permission

• Reproduce, duplicate, or exploit the Service except as expressly permitted

7.2 User Content and Conduct
You are solely responsible for all content you upload, submit, generate, or transmit through the Service. Architect Render may monitor, review, remove, or disable access to any User Content or account at any time and for any reason, and may cooperate with law enforcement authorities.
User Content may be deleted, removed, or anonymized if it is found to be in violation of these Terms, upon account termination, or after a period of inactivity in accordance with Architect Render’s data retention policies.
7.3 Reporting Violations
If you believe that any content, user, or activity on the Service violates these Usage Rules or any applicable law, please promptly report the issue to admin@architectrender.com.
7.4 Compliance with Laws
You are responsible for ensuring that your use of the Service and all User Content complies with all applicable laws, rules, and regulations.
7.5 Consequences of Violation
Violation of these Usage Rules may result in immediate suspension or termination of your access to the Service, removal of prohibited content, legal action, and/or reporting to the relevant authorities.

8. File Management, Storage & Supported Formats

8.1 Project Access
Users may opt into Architect Render's project file management system for cloud-based access to past rendering projects. This service requires an additional annual fee of $4.99 and allows review, sharing, editing, and deletion of past projects across devices. Users can opt out at any time while maintaining access to other platform features.
8.2 Compatible Files
The platform accepts various image formats including but not limited to: .jpg, .jpeg, .png, .heic

9. User Content, Personal Information & Data Protection

9.1 User Content Ownership and License
You retain all rights, title, and interest in and to any content, images, designs, data, project files, prompts, feedback, or material you upload, submit, create, or otherwise generate using the Architect Render platform, subject to the rights expressly granted in these Terms.
By uploading, posting, submitting, or otherwise transmitting User Content, you grant Architect Render and its affiliates a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, host, store, reproduce, modify, display, and process your User Content solely for the purpose of operating, maintaining, improving, developing, and supporting the Service, and as otherwise required by law.
You represent and warrant that you own or have obtained all necessary rights for any User Content you submit, and that your User Content does not infringe or violate any third-party rights or applicable laws.
9.2 Use and Disclosure of User Content
Architect Render will not publicly display, share, or distribute your User Content except as necessary for providing the Service, as permitted by you, or as required by law. If you participate in community features, some User Content you submit may be visible to others and used by Architect Render for any reason related to the Service as well as depending on your settings and the nature of your participation.
9.3 Third-Party Service Providers
To deliver and enhance the Service, Architect Render may share User Content with trusted third-party vendors subject to contractual obligations of confidentiality and data protection.
9.4 Protection of Personal Information
Architect Render collects and uses personal information as described in our Privacy Policy and employs industry-standard technical and organizational measures to protect your data. You have the right to access, correct, amend, or delete your personal information.
9.5 Data Transfers and Retention
Personal information may be stored and processed in the United States or other countries. Architect Render retains User Content and personal information as long as necessary to fulfill service purposes or as required by law.
9.6 No Sensitive or Prohibited Data
You agree not to upload any sensitive personal information unless expressly requested and permitted by Architect Render.

10. AI Technology and Third-Party Integrations

Architect Render employs proprietary AI software and prompting architecture to generate architectural renderings. Output quality depends on input image quality, prompt specificity, style reference selection, and user-directed edits. Users have customization options, including reference image/design upload, style reference selection, and detailed prompting.
Architect Render integrates services from third-party vendors (including Freepik, Virtual Staging AI, Novita AI, and others) to enhance platform capabilities. Use of these integrations is subject to the terms of both Architect Render and the respective third-party provider. Architect Render does not guarantee continuous availability of third-party services and is not liable for service interruptions, quality variations, or changes in third-party offerings.

11. Links to Third-Party Sites and Expert Network

11.1 Third-Party Websites and Resources
The Platform may contain links to third-party websites, services, content, or resources (“Linked Sites”) that are not owned or controlled by Architect Render. These links are provided for convenience only, and Architect Render disclaims responsibility for any aspect of Linked Sites. Your use of Linked Sites is at your own risk and subject to their terms.
11.2 Expert Network
For complex projects, users may access Architect Render's network of vetted architectural rendering and interior design professionals through our partnership with Upwork. Professional services are billed separately, and Architect Render is not responsible for work performed outside of the platform.

12. Community & Customer Support

12.1 Community Access
Users receive access to exclusive Discord community, forums, rendering tutorials, contests, and partner-exclusive offers.
12.2 Support Response Times

• Initial response within 24 hours

• Issue resolution at least 72 hours (average)

• Timeline may vary based on issue complexity and ticket volume

13. Disclaimers, Limitations, and Waivers

13.1 Disclaimers
Architect Render provides the Platform and all associated services “as-is” and “as-available” and makes no warranties, express or implied, regarding reliability, quality, or suitability. AI-generated outputs are for informational purposes only and do not constitute professional advice.
13.2 Limitations of Liability
To the maximum extent permitted by law, Architect Render is not liable for any indirect, incidental, special, punitive, or consequential damages. Aggregate liability is limited to the greater of (i) the amount paid by you to Architect Render in the twelve (12) months prior, or (ii) $100.
13.3 Waivers
You assume all risks associated with use of the Platform. Architect Render is not liable for user content or actions. By using the Platform, you waive any and all claims against Architect Render to the fullest extent permitted by law.
13.4 Indemnification
You agree to indemnify, defend, and hold harmless Architect Render and its affiliates from any claims, losses, or damages arising from your use of the Platform, your content, or your violation of these Terms.
13.5 Force Majeure
Architect Render shall not be liable for any failure or delay due to circumstances beyond its reasonable control.

14. Refund Policy

Refund requests will be considered when:

• The request is made within 15 days of purchase

• Proof of purchase is provided

• The user has not violated these terms

• Technical review is performed of any issue in question

15. Rights of European Union Residents (GDPR)

Users in the EEA, EU, UK, and Switzerland have specific rights under the GDPR, including rights to access, rectify, erase, restrict, or object to data processing, data portability, and to lodge complaints. 16. Governing Law and Dispute Resolution

These Terms are governed by New York law unless otherwise required by local law. Disputes will be resolved in New York County courts or through binding arbitration under AAA rules. Class action and jury trial waivers apply. Claims must be brought within one (1) year.

If any provision is found invalid or unenforceable, it will be replaced by a valid provision reflecting the original intent, and the remainder will remain in effect.

18. Miscellaneous

These Terms constitute the entire agreement between you and Architect Render. You may not assign your rights without consent. Architect Render may assign its rights at any time. No waiver is effective unless in writing. Notices must be in English and sent to the addresses provided in these Terms.
